FRAMPTON PRODUCTION TERMS AND CONDITIONS OF HIRE

1) The Parties

The “Owner” Frampton Production, and the “Hirer” is the person who completes and signs the hire agreement. The hirer acknowledges that he / she is over 18 years of age and is authorised to meet the contractual obligations of this agreement, where the person or organization using the equipment differs from the person completing the hire agreement.

2) Hire Period

The hire period is defined as the time equipment leaves the Frampton Production store until it is returned to Frampton Production. Any extra time over the estimated schedule will be deemed to be additional hire and charged accordingly. Failure to return the equipment on time may incur consequential costs which are incurred by Frampton Production.

3) Equipment

(a) The equipment hired is agreed to be as defined on the Hire Agreement.

(b) The equipment may not be sub-hired to any 3rd party without the express written permission of Frampton Production.

(c) Frampton Production does not represent or warrant that the equipment supplied or its capacity or performance is fit for the purpose for which the hirer requires.

(d) While every endeavor is made to supply the equipment ordered, Frampton Production reserves the right to substitute other equipment where necessary.

(e) Frampton Production will not be responsible for any delays, accidents, or loss or damage of any kind, direct or consequential, which may arise through defects or breakdown of the equipment hired.

(f) Frampton Production reserves the right to inspect and check for any safety or environmental issues or maintain the equipment at any time.

(g) The hirer shall return the equipment to Frampton Production with all packaging, accessories, clean, and in good order as delivered.

(h) Any equipment exposed or subject to the ingress of haze or smoke fluid/oil will incur cleaning fees. Parts and/or filters requiring replacement will be charged according.

4) Delivery

a) Hire charges are ex Frampton Production’s store. Any freight or delivery charges incurred by the owners on the hirer’s behalf will be charged to the hirer.

b) All equipment is usually suitably packed or supplied in Frampton Production containers. This packing must be returned with the equipment, otherwise its cost will be charged to the hirer.

c) Frampton Production will endeavor to supply equipment as ordered but cannot accept responsibility for non-delivery, delay in delivery, or inability to supply when desired.

d) The restocking fee applies to all equipment hired, whether used or not, and covers the costs of safety testing and checking equipment when it is returned to store in

preparation for next use.

5) Faulty Equipment

If the hirer considers any equipment to be faulty they must notify Frampton Production immediately and the hire will cease from the time such notification is received until it is assessed to be operable or repaired by Frampton Production. In such circumstances, Frampton Production may choose to repair or replace any faulty equipment at their sole discretion and expense.

6) Loss or Damage

a) The Hirer accepts full responsibility for loss or damage however caused from the time the equipment is delivered from the Frampton Production store or vehicle to the hirer or carrier, until returned to Frampton Production, or vehicle.

b) The hirer acknowledges that they have arranged or considered the implication of appropriate insurance for the equipment whilst under their care.

c) The hirer undertakes a duty of care for the equipment at all times in terms of security, storage, weatherproof environment and cleanliness.

d) The hirer acknowledges their responsibility to provide consistent and appropriate electrical power to preserve the maintenance and quality of the equipment in accordance with Electricity Safety Regulations 2010.

e) Any equipment which is damaged or destroyed must be removed from service, notification made to Frampton Production immediately and returned if possible.

7) Owners Liability

The owner accepts no liability whatsoever in respect of any third party or similar risks, or for personal injury arising from damage of any kind including improper or unintended use of equipment or whereby equipment is used by or installed by unskilled or unqualified persons.

8) Payment

(a) All hire charges are to be paid in full before delivery unless by prior arrangement.

(b) Additional rental charges at the rate quoted will be made for overdue returns after 10.00am on the last day specified.

(d) Frampton Production accepts cash, online payments or direct credit payments.

9) Cancellation

In the event of cancellation, the hirer will pay a cancellation fee; 50% will be payable on cancellation within 7 days of scheduled installation time and 100% payable on cancellation within 48 hours of scheduled installation time.

10) Termination

If there is any breach of these terms and conditions, Frampton Production reserves the right to terminate the hire period forthwith, and take any steps necessary to recover possession of the equipment without prejudice to the right to recover all amounts due for the hire, reconditioning of the equipment, and costs of transport to Frampton Production.

11) Property Rights

All equipment remains the absolute property of Frampton Production. The hirer undertakes to keep the equipment in his or her own control, and free from all liens, charges, encumbrances and any other interests whatsoever.

12) Acceptance

Notwithstanding that the hirer may not have signed this agreement, the acceptance by the hirer of the goods on hire shall in itself constitute an acceptance of the terms and conditions, and charges stated on the accompanying hire agreement.

EVENT EXPERIENCE RENTALS- TERMS AND CONDITIONS OF HIRE

1) Booking & Payments

A non-refundable deposit of 20% (or $100 NZD, whichever is greater) is required to secure any booking date. Full payment is due prior to delivery and setup. Overdue balances incur penalty interest of 2% per month plus all recovery and collection fees. Cancellations within 7 days of setup incur a 50% fee; cancellations within 48 hours incur a 100% fee.

2) Unattended Drop-Off, Security Bond & Guest Care

(a) Duty of Care: The Hirer assumes total responsibility for gear safety and guest supervision from delivery to extraction. The Owner reserves the right to retain security bond funds for minor damage, missing accessories, or excessive cleaning fees.

(b) Guest Damage: The Hirer is directly liable for liquid spills, tip-overs, screen damage, or missing props caused by event guests, venue staff, or attendees.

(c) Strict Protocols: Gear must not be moved, re-positioned, or relocated once set up by the Owner. Food, liquids, open flames, and markers are strictly prohibited near fabric backdrops and prop sets.

3) Venue Access, Power & Wellington Weather

(a) The Hirer must provide clear venue access, flat ground, and a continuous 230V power supply within 10 meters (unless a battery unit is specified).

(b) Wellington Weather Protection: Equipment must be fully protected from rain, moisture, direct sunlight, and extreme conditions. The Owner reserves the absolute right to modify or cancel outdoor setups if severe weather or high winds threaten equipment safety.

4) Digital Media, Privacy & Network Limitations

(a) The Hirer confirms they have obtained guest consent for photo/audio capture. Non-confidential media may be used for marketing unless explicitly opted out in writing prior to the event.

(b) Personal data is handled strictly per our Privacy Policy at https://www.framptonproduction.com/privacy-policies.

(c) Instant sharing (SMS, QR, AirDrop) requires local network signals. Connectivity delays due to weak venue internet do not constitute a failure of service or grounds for refunds (media queues and uploads automatically once reconnected).

5) Liability & Binding Acceptance

The Owner accepts no liability for third-party risks or injury arising from improper use. Payment of a deposit, booking confirmation, or taking delivery of gear constitutes full legal acceptance of these terms alongside our online Terms of Service at https://www.framptonproduction.com/terms-of-service.
